Right of withdrawal

Consumers generally have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

Exclusion of the Right of Withdrawal for Personalized EVOLURE Products

The artworks offered in the EVOLURE Shop are custom-made according to your specifications, photos, motifs, wishes, size and material selections, and other personal requirements.

According to § 312g para. 2 no. 1 BGB (German Civil Code), the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Therefore, there is no statutory right of withdrawal for personalized EVOLURE products. A return or cancellation within the framework of a free withdrawal is excluded if the ordered product is custom-made according to your specifications.

Your statutory rights regarding defects remain unaffected by this.

Right of withdrawal for non-personalized standard goods

Unless we exceptionally offer non-customized, pre-fabricated standard goods, the following cancellation policy applies to consumers.

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of cancellation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs, without undue delay and at the latest within 14 days from the day on which we received notification of your revocation of this contract.

This does not apply to additional costs incurred because you chose a different type of delivery than the cheapest standard delivery offered by us.

For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

Return and Compensation for Loss in Value

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the 14-day period.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
